Summary
The decree of the Minister of the Interior establishes the detailed implementing rules for the technical supervision of preventive restraining orders, with particular regard to the application of technical devices tracking the movement of the abuser. The regulation defines the tasks of police headquarters in the areas of installation and supervision of technical devices and monitoring compliance with rules of conduct, and also sets out the abuser's obligation to cooperate and the rules governing the payment of fees. The purpose of the decree is to provide more effective protection for victims of domestic violence, on the basis of the authorisation contained in Act LXXII of 2009.

Decree No. 36/2025. (IX. 3.) BM of the Minister of the Interior on the detailed rules relating to the enforcement of preventive restraining orders
[1] In the interest of public safety and the protection of persons, the effective enforcement of preventive restraining orders is indispensable. Modern technological means provide the opportunity for the movements of persons subject to a restraining order to be continuously monitored, thereby ensuring enhanced protection of the rights and physical integrity of victims of abuse. The application of technical surveillance contributes to the prevention of violations of the law, as well as to the swift and effective action of the authorities.
[2] With due regard to the balance between legal certainty and the protection of privacy, the purpose of this decree is to lay down the detailed rules for the technical supervision of preventive restraining orders. The aim of the regulation is to ensure that the application of technological solutions is proportionate, lawful and effective, taking into account the fundamental rights of both the victims of abuse and the perpetrator.…
