Summary

Government Decree 290/2025 expands the competence of the counter-terrorism authority during the state of danger in order to address the terrorist threat related to the armed conflict in Ukraine. The Decree enables the authority, on the basis of a decision by the minister responsible for law enforcement, to obtain information of foreign relevance independently or in cooperation with the national security services, and to operate abroad using its special capabilities. The measures set out derogations from the Act on the Police applicable during the state of danger and also grant authorisation for covert intelligence gathering.

Government Decree No. 290/2025. (IX. 11.) on the emergency rules for the prevention and countering of terrorism

[1] The increase in crime related to the Ukrainian conflict poses a continuous security risk, which also includes the threat of terrorism, and therefore governmental intervention is necessary.

[2] The decree establishes provisions having regard to the armed conflict and humanitarian catastrophe on the territory of Ukraine, and in view of the rapidly changing situation in the area of terrorist threat.

[3] The Government, acting in its original legislative authority as defined in Article 53(1) of the Fundamental Law, having regard to Sections 80 and 81 of Act XCIII of 2021 on the Coordination of Defence and Security Activities, acting within the scope of duties defined in Article 15(1) of the Fundamental Law, hereby orders the following:

Section 1. During the state of danger declared pursuant to Government Decree No. 424/2022. (X. 28.) on the declaration of a state of danger and certain emergency rules with regard to the armed conflict and humanitarian catastrophe on the territory of Ukraine, as well as for the purpose of averting and managing their consequences in Hungary, Act XXXIV of 1994 on the Police (hereinafter: Police Act) shall be applied with the derogations and supplements set out in this decree.…
