Summary
Government Decree 49/2025 prohibits credit institutions, as an emergency rule, from discontinuing already operating ATMs or suspending cash withdrawal services in their bank branches. In the event of a breach of the prohibition, the Magyar Nemzeti Bank may impose a fine of between 2 million and 200 million forints on the operator concerned. Government Decree 50/2025 amends the rules on the emergency application of the Act on public finances, primarily with regard to the accountability of budgetary subsidies and the obligation to maintain treasury accounts for subsidy advances. III. Government Decrees
Government Decree No. 49/2025. (III. 24.) on the maintenance of the operation of automated teller machines during a state of emergency
[1] Ensuring access to cash is of paramount importance in rural areas, and it is therefore essential that already operating automated teller machines do not cease to function.
[2] The Government's objective is to ensure that the misguided Brussels sanctions introduced on account of the Ukrainian-Russian war do not result in disruption to the cash supply of the population.
[3] Acting in its original legislative competence as defined in Article 53(1) of the Fundamental Law, having regard to Sections 80 and 81 of Act XCIII of 2021 on the Coordination of Defence and Security Activities, and acting within the scope of duties defined in Article 15(1) of the Fundamental Law, the Government hereby orders the following:
Section 1. Act CXXXIX of 2013 on the Magyar Nemzeti Bank shall be applied with the derogations and supplements set out in this Decree during the state of emergency declared pursuant to Government Decree No. 424/2022. (X. 28.) on the declaration of a state of emergency and certain emergency rules with regard to the armed conflict and humanitarian catastrophe existing on the territory of Ukraine, as well as for the purpose of preventing and managing their consequences in Hungary.
