Summary

The decree regulates the suitability requirements applicable to the management bodies of credit servicers dealing with non-performing loans and to the members of such bodies, with the aim of protecting borrowers and strengthening confidence in lending. Credit servicers are obliged to lay down in internal regulations the assessment criteria for members of the management body, and suitability must be reviewed in specified cases — in particular upon commencement of operations, upon appointment, or upon a material change in duties. The regulation does not extend to those credit institutions and financial enterprises that already hold a licence for the granting of credit and cash loans or for the purchase of receivables.
