Summary

The Government of Hungary and the Government of Romania have concluded a bilateral agreement for the preservation of security of natural gas supply, which is promulgated by Government Decree No. 109/2025. The agreement, on the basis of Article 13 of EU Regulation 2017/1938, lays down the technical, legal and financial rules of the solidarity mechanism, which serve to ensure the gas supply of protected customers in the event of an emergency. The minister responsible for energy policy and foreign economic affairs shall ensure the implementation of the decree.

II. Government Decrees

Government Decree No. 109/2025. (V. 26.) of the Government on the promulgation of the Agreement between the Government of Hungary and the Government of Romania on solidarity measures to maintain the security of gas supply

[1] The fundamental objective of Hungary's energy policy is to maintain security of supply, which also constitutes a prerequisite for maintaining affordable and competitive energy prices.

[2] This objective also necessitates ensuring preparedness for potential supply security challenges in the field of natural gas supply.

[3] In accordance with Regulation (EU) 2017/1938 of the European Parliament and of the Council, in the event of potential gas supply crises, neighbouring Member States may contribute to the preservation of each other's energy security through solidarity measures.

[4] Based on the foregoing, it is justified that the technical, legal and financial rules relating to solidarity measures be established by bilateral agreements; therefore, the Government of Hungary and the Government of Romania have agreed on the following bilateral solidarity measures in order to strengthen the security of gas supply:
