Summary
The government decree contains an amendment to Government Decree No. 410/2012 regulating the trading system of greenhouse gases, the purpose of which is to establish alignment with the Act on climate gases adopted in 2024. The amendment confirms the nationwide jurisdiction and statutory subordination of the National Climate Protection Authority, extending its competence to shipping companies as well. In addition, it introduces new obligations relating to the fulfilment of sustainability requirements for biomass fuels, as well as reporting and monitoring obligations for operators of installations registered in the ETS system.

Government Decree No. 127/2025. (VI. 5.) of the Government
on the amendment of Government Decree No. 410/2012. (XII. 28.) on certain rules for the implementation of Act CCXVII of 2012 on participation in the Community trading system for greenhouse gases and the implementation of the effort-sharing decision
[1] The National Assembly adopted the Act on Climate Gases at the end of 2024. The purpose of the amendment is, on the one hand, to create consistency between the provisions at the level of government decree and Act CCXVII of 2012 on participation in the Community trading system for greenhouse gases and the implementation of the effort-sharing decision, as amended by the Act on Climate Gases, and, on the other hand, to address legal application problems that have arisen in the course of proceedings of the National Climate Protection Authority.
[2] The Government, acting on the basis of the authorisation granted in points 1–5, 7, 9–18, 31 and 32 of Section 39(1) of Act CCXVII of 2012 on participation in the Community trading system for greenhouse gases and the implementation of the effort-sharing decision, acting within the scope of its duties as defined in Article 15(1) of the Fundamental Law, hereby orders the following:…
