Summary
Government Decree 138/2025 supplements the contract modification rules applicable to grants provided from the Bethlen Gábor Fund, enabling the objective set out in the grant agreement to be modified, under specified conditions, on no more than one occasion. The modification may be initiated by the grantor, the beneficiary, or both parties jointly, in particular where the original objective of the supported activity becomes impossible to achieve or is threatened by a delay of at least three months. The Decree furthermore regulates the rules on accounting and the reimbursement of unused grant amounts, derogating from the general provisions applicable to unlawful utilisation.

III. Government Decrees
Government Decree No. 138/2025. (VI. 19.) on the amendment of Government Decree No. 367/2010. (XII. 30.) on the implementation of Act CLXXXII of 2010 on the Bethlen Gábor Fund
[1] The Government's objective is to ensure that, in the case of grants provided from the Bethlen Gábor Fund, there is also a possibility to modify the grant objective specified in the grant agreement, however, exclusively on one occasion.
[2] The Government, acting on the basis of the authorisation granted in Section 18(1)(a) of Act CLXXXII of 2010 on the Bethlen Gábor Fund, and acting within the scope of duties defined in Article 15(1) of the Fundamental Law, hereby orders the following:
Section 1. Chapter V/C of Government Decree No. 367/2010. (XII. 30.) on the implementation of Act CLXXXII of 2010 on the Bethlen Gábor Fund is supplemented by the following Section 32/H:
"Section 32/H. (1) The modification of the grant agreement in accordance with the provisions of Section 3/A of the Bgatv. is permissible on at most one occasion, provided that the condition for granting the support is not based on a statutory provision, and the decision-maker has discretionary power in the course of adopting the grant decision.
(2) The modification of the grant agreement pursuant to subsection (1) may be initiated unilaterally by the grantor or the beneficiary, as well as jointly by the grantor and the beneficiary.…
