Summary
The Government Decree No. 25/2026. (II. 19.) amends Government Decree No. 37/2011. (III. 22.) in the context of the regulation of State aid in the form of public service compensation granted to undertakings entrusted with the operation of services of general economic interest, incorporating the provisions of Commission Decision (EU) 2025/2630 alongside the previous Decision 2012/21/EU. The amendment specifies the substantive requirements for aid schemes, the accounting and reporting obligations incumbent upon beneficiaries, as well as the upper limits applicable to the amount of compensation. Furthermore, it establishes a maximum of 75 percent for regional aid intensity and supplements the Union law references of the decree.

III. Government Decrees
Government Decree No. 25/2026. (II. 19.) on the amendment of Government Decree No. 37/2011. (III. 22.) on the procedure relating to state aid in the sense of European Union competition law and on the regional aid map
[1] In accordance with European Union law, the financing of the provision of public services falls within Member State competence — without separate approval by the European Commission — and has been possible since 8 January 2026 on the basis of Commission Decision (EU) 2025/2630 of 16 December 2025 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest and repealing Decision 2012/21/EU.
[2] The regulation amends the relevant provisions of the Government Decree in accordance with the EU state aid background legislation.
[3] The Government, acting on the basis of the authorisation granted under Section 109(1) point 15d of Act CXCV of 2011 on Public Finances, and acting within the scope of duties defined in Article 15(1) of the Fundamental Law, hereby orders the following:
Section 1. Section 19 of Government Decree No. 37/2011. (III. 22.) on the procedure relating to state aid in the sense of European Union competition law and on the regional aid map shall be replaced by the following provision:…
