Decision 2/2026. JEH of the Kúria (case number Jpe.III.60.003/2025/16) on a cross-application for review lodged solely against the reasoning of a final judgment

The Uniformity Panel of the Kúria, on the basis of a preliminary ruling motion submitted by Panel P.I. of the Kúria, has adopted the following

uniformity decision:

1. A cross-application for review lodged solely against the reasoning of a final judgment must in every case be rejected.

2. The proposing panel of the Kúria may depart, in the question of statutory interpretation addressed in point 1, from decision no. Gfv.30.002/2024/10 published in the Collection of Court Decisions.

3. Decision no. Gfv.30.002/2024/10 of the Kúria published in the Collection of Court Decisions, and other decisions of identical content, may no longer be cited as binding authority in the question of statutory interpretation addressed in point 1.
